TERMS OF SERVICE

 

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Bella Phytologic, Inc. (“Company,” “we,” “us,” or “our”), concerning your access to and use of the website https://bellaphytologic.com as well as any other media form, media channel, mobile website, or related, affiliated, or otherwise connected e-commerce storefronts owned, operated, or managed by Bella Phytologic, Inc., including but not limited to:

  • Pin Up Girl Wellness 

  • Ellovi 

  • Perfect Vitamin Products

  • Healthy Herbs Store

  • Sierra Life Sciences

  • Scientific Health Solutions

(collectively, the “Sites”). You agree that by accessing the Sites, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Sites and you must discontinue use immediately.

2. HEALTH & MEDICAL DISCLAIMER

The Sites provide health, wellness, cosmetic, and nutritional product information designed for educational and consumer informational purposes only.

  • No Medical Advice: The information, products, and claims found on the Sites are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

  • FDA Disclaimer: The statements made regarding any supplements, vitamins, herbal formulations, or topical products across our Sites have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

3. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Sites and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Sites (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by Bella Phytologic, Inc., and are protected by copyright and trademark laws. No part of the Sites, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

 

4. USER ACCOUNTS & AUTO-GENERATION

When you interact with our e-commerce platforms, checkout screens, or registration windows:

  • You agree to provide accurate, current, and complete purchase and account information for all purchases made via the Sites.

  • System Automated Accounts: To facilitate order tracking, automated shipping notices, and fulfillment logistics via our WordPress/WooCommerce infrastructure, our system may securely create a basic customer profile or account using your checkout information.

  • We reserve the right to terminate accounts, edit content, or cancel orders in our sole discretion if account information is found to be fraudulent, inaccurate, or associated with automated spam activity.

5. PURCHASES, PRICING, & SUBSCRIPTIONS

We accept major credit cards, as well as express payment methods (including Apple Pay, Google Pay, and PayPal Express Checkout) routed through our secure payment gateways.

  • Pricing Clarity: We strive to display product pricing clearly. Where “Subscribe & Save” or recurring billing options are offered, the one-time purchase price and the recurring subscription price will be clearly delineated.

  • Subscription & Automatic Renewal: If you purchase a recurring subscription order, your subscription will automatically renew at the specified frequency (e.g., monthly) and your saved payment method will be charged the subscription rate automatically until you cancel.

  • Cancellation: You may cancel your product subscription at any time by logging into your account dashboard on the respective brand Site, or by contacting customer support. To avoid being charged for your next scheduled shipment, cancellation requests must be processed prior to the automatic renewal billing date.

6. SHIPPING & FULFILLMENT

All orders placed across our portfolio of brands are hand-packed, managed, and securely shipped directly from our primary corporate production and fulfillment facility. We do not dropship from unverified third parties. Estimated delivery windows provided at checkout are estimates only, and we are not liable for transit delays caused by third-party shipping carriers (e.g., USPS, FedEx).

7. LIMITATION OF LIABILITY

In no event will Bella Phytologic, Inc., or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Sites or products purchased through the Sites, even if we have been advised of the possibility of such damages.

 

8. GOVERNING LAW & JURISDICTION

These Terms of Service and your use of the Sites are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding brought relative to these terms shall be handled exclusively in the state or federal courts located within Sonoma County, California, USA.
